Rebalancing our regulatory response to Deepfakes with performers’ rights

Law experts have been actively looking for solutions within the law to control Deepfakes since their emergence in 2017. This article puts forward performers’ rights as a suitable regulatory tool Deepfakes, defined synthetic performances produced using artificial intelligence systems. In many respects, represent more sophisticated response challenges posed by Deepfake technology compared existing legal remedies and reform proposals introduced regulate Deepfakes. making its case this uncovers tension: are an attractive solution but scope of application. is because uses content protected (performances) way unforeseen intellectual property policy-makers at time these were into law. Despite limitation, remain one most regulating if adequately reformed. proposes two routes address gap. The first involves ad hoc modification ensure that manipulated covered. second preferred recommendation replaces regime with copyright. small, yet important, change regimes can be difference between piecemeal, uneven and, therefore, ineffective protection against unauthorized harmonized international approach technology.
